Terms and Conditions

Official Terms and Conditions of the  Voices of Impact Awards™:

These Terms and Conditions apply to all services that are operated by or organized by “Impact Speaker Awards, LLC.” (herein “Organizer”).  

By submitting an Official Application to the Awards you will be deemed to have read and accepted these Terms and Conditions and you agree to abide by them together with any specific instructions, rules, regulations, or additional terms for the Awards which may be mentioned in any electronic messages, or on the website, or information communicated to participants in any other way including but not limited to the “Awards Details” which include the below items:

The Organizer may cancel, modify, or amend any Awards, Awards Details, or these Terms and Conditions without prior notice. Any changes will be posted either within the Awards Details or these Terms and Conditions. 

GENERAL

The Voices of Impact Awards™ (the “Awards”), was created to celebrate and equip the voices that inspire humanity. No prior experience is required.

The opening and closing application dates and times are as indicated in the Awards Details. Any applications received after the closing of the application period shall be entered into consideration for the following year’s Awards.

Application to the Awards may only be made through the applicable method(s) indicated in the Awards Details. When participants pay an application fee, they must have the permission of the person responsible for payment of the fee before entering; otherwise, the application will be deemed invalid.

When an Official Application is properly completed and received by the Organizer, the participant will receive an email message confirming their acceptance into the Awards together with follow-up messages relating to schedules, due dates, and other relevant information. 

Participants are required to supply their full legal name, age, current and valid email address, address, contact telephone number, and/or any other details sufficient for the Organizer to contact the participant. 

By submitting an Official Application, the participant agrees to receive email, text, phone calls, or other communication from the Organizer.

If a participant elects to opt out from receiving any communication from Organizer, or if participant fails to timely respond to any communication from Organizer as may be required, participant shall be deemed to have withdrawn from these Awards. The participant may still enjoy some of the other benefits, such as the complimentary training.

Participants must use the relevant payment service indicated in the Awards Details to apply for the Awards and may need to open an account and register with a third-party payment processor to pay for online application to the Awards.

TRAINING

Participants may receive complimentary training, products or services designed purely for educational and or entertainment purposes. These may include books, guides, videos, and other digital learning or instructional material. Organizer makes no warranties or guarantee that any of the training will provide a specific result, outcome, or that it will provide any advantage for the participant in or out of this Awards program. Organizer does not endorse any training material, product, service or any person or company providing such training material, product, or service, and assumes no liability or responsibility for any expense that may be incurred by participant arising from or in connection with any training material or with any person or company providing such training material.  

INTELLECTUAL PROPERTY

By entering the Awards, a participant warrants that all application information submitted by them is true, current, and complete. Participant also warrants that they are the copyright owners of any works submitted, e.g., talks, videos, photographs, or other application materials, and the use by the Organizer of such works (which you will permit), do not and will not infringe the rights of any third party.

By applying for and participating in these Awards, the participant understands that he or she will retain all intellectual property rights in and to the content of their presentation (the “Content”). Notwithstanding, participant agrees that Organizer, and or its assigns, shall have the exclusive right to record via audio, video or by any other means, and to publish, broadcast, live stream, distribute, display, publicize, adapt, in whole or in part, any presentation or performance by participant of the content in these Awards, without limitation, throughout the universe, in perpetuity.    

While the Content shall belong to the participant, Organizer shall own and retain all intellectual property rights in any recording, audio, video, photograph, image, graphics, artwork, or other reproduction of the Content or performance of the Content (the Performance Assets”), without limitation, throughout the universe, in perpetuity. This includes interviews, podcasts, and similar content that the Organizer produces and on which the participant may appear.

By participating in these Awards, participant is authorized to display, publish, and broadcast any Performance Asset containing their performance, on any website, blog, social media account or channel owned by or managed by participant for promotion and marketing purposes only. Participant may not edit, modify, or alter any Performance Asset, and may not reproduce, repackage, sell, or offer for sale, or allow any 3d party to sell or offer for sale any Production Asset.

The broadcast or display by Organizer of any Production Asset which includes a participant’s Content, shall not be deemed as an endorsement by Organizer of any opinions, statements, values, or other message expressed therein.

TRADEMARK RESTRICTIONS

The name Voices of Impact Awards™ and logo, the “Blue Diamond Impact Award™”, “Lifetime Impact Award™”, “Rising Impact Award™”, “Heidi Service Award™”, “Student Impact Award™” are the exclusive marks of Impact Speaker Awards, LLC, and no unauthorized use may be made of said marks without the express written authorization of Organizer.

A participant who has met the eligibility requirements and has complied with all applicable rules, regulations, Terms and Conditions of these Awards is granted permission (a trademark license), to identify themselves as having applied for and that they are a participant, or that they have previously participated in these Awards, and to announce or display an official badge, as may be supplied by Organizer. This right is non-exclusive and may be revoked at any time.

Organizer may terminate the foregoing trademark license if, it deems, in its sole discretion, that participant’s use of the mark(s) tarnishes, blurs or dilutes the quality associated with the marks or the associated goodwill and such problem is not cured within 10 days of notice of breach. Participant shall use the marks exactly in the form provided and in conformance with any trademark usage policies. Participant shall not take any action inconsistent with the Organizer’s ownership of the marks, and any benefits accruing from the use of such marks shall automatically vest in the Organizer. The participant shall not form any combination marks with the Organizer’s marks.

NO LIABILITY

Organizer and its members, servants, agents, employees, officers, and any other third party or organization involved in the management, promotion, or administration of the Awards, together with their agents or subsidiaries shall not be responsible or be held liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to applications, questionnaires, videos, or for any such items that are lost or delayed whether or not arising during operation or transmission as a result of server functions (including but not limited to security functions by any software used by Organizer or any third party), virus, bugs, or other causes.  

Any applications which are incomplete, incorrect, inaudible, incomprehensible, or not received by the Organizer by any deadline will be void and any application fees paid together with any such application will not be refunded.

In the event of any fault, mistake, misunderstanding, or dispute concerning the correctness or acceptability of any application, or the operation of any part of the Awards (in the case of internet outage for example), network or phone system, the decision of the Organizer shall be final. 

The organizer will not be liable to reimburse expenses incurred in making an application into the Awards. Organizer reserves the right to issue refunds as it, in its sole discretion may deem appropriate, or refuse to refund any application where it suspects dishonest or fraudulent conduct on the part of the person(s) submitting the application or where the participant has not complied with the Awards Details.

The organizer will not be liable if all or any part of the service relating to the Awards is discontinued, modified, or changed in any way. The Organizer is not responsible for the delivery of any gifts, prizes, or other items offered by a 3d party such as a Sponsor, Official Resource Partner, or other person or entity, and shall not be held liable for the failure of any party to deliver such gifts or prizes.  

PRIZES

The prize(s) to be awarded in these Awards are as specified in the Awards Details.  The process for determining the recipient of the awards prize(s) is as indicated in the Awards Details. 

These Awards are not a sweepstakes, lottery, contest, nor are they a game of chance. Awards recipients will be selected based on the nature and quality of their content, and presentation, their communication skill and ability to inspire, educate, persuade, influence, or entertain through the delivery of their message. A specific level of education and experience as a public speaker is not required. All participants will be judged subjectively, and this subjective assessment and judging will be made by persons designated by Organizer who are experienced speakers, coaches, trainers, presenters, performers, writers, educators, or who otherwise possess the ability to make such subjective assessments. Any and every decision made by such persons shall be final and will not be subject to scrutiny, examination, or reversal for any reason. 

The Organizer reserves the sole and unfettered right, in its sole discretion, to remove and disqualify any participant, or other person acting on behalf of any participant from the Awards, or from the premises of the Awards Gala, in the case of actual or suspected cheating, fraud, collusion, bribery, or other criminal activity by the participant and or any person acting on behalf of the participant. In the event of such removal or disqualification, the Organizer may, in its sole discretion select an Alternate to replace the disqualified participant. 

If selected as a Finalist, each participant will have a specified fixed time in which to accept and confirm their ability to participate in and appear at the Awards Gala, at the location identified in the Awards Details.

If the Organizer is unable to notify any Finalist after three or more attempts to do so, or if the Finalist fails to respond within the fixed time as specified in the Awards Details, this may result in forfeiture and disqualification from the Awards and the Organizer shall have the right to select an Alternate Finalist in accordance with these Terms and Conditions and the Awards Details. 

Organizer reserves the right, in its sole discretion, to withhold the announcement of any winners, or the delivery of any prize(s), until such proof of eligibility and identity has been confirmed or if such proof is not produced on request or to disqualify the participant from the Awards. 

Organizer may, in its sole discretion, refuse to provide a prize, or may seek its recovery, in the event of non-entitlement under these Terms and Conditions or a participant’s breach of these Terms and Conditions or Awards Details,  fraud, dishonesty, or other inappropriate or improper conduct including but not limited to attempts to influence the judging or result of the Awards, or the use of technology which enables a participant to evade application fees, or application requirements, or enter more than once. 

Any participant who enters or attempts to enter the Awards in a manner contrary to these Terms and Conditions, or by its nature is unfair to the other participants, may be disqualified and removed from the Awards. Any Awards or prizes otherwise due to a participant that has been disqualified shall be forfeited and Organizer reserves the right to reclaim any prize(s) already distributed to the participant.

The Organizer reserves the right to modify, cancel, terminate or suspend the Awards in whole or in part, at its sole discretion, if it believes the Awards is not capable of being conducted as specified in these Terms and Conditions, or in the event of a virus, computer bug or unauthorized human intervention, act of nature, or any other cause that is beyond the reasonable control of Organizer that could corrupt or affect the administration, security, impartiality, or normal course of the Awards. 

Voices of Impact Awards™ reserves the right to substitute prizes of equal or greater value at any time during the duration of the Awards program. Additional prizes may be added or substituted, at the Organizer’s discretion.

PUBLICITY RELEASE

By entering these Awards, the participant grants Organizer permission together with a non-exclusive license to use and publish the participant’s name, photograph, image, voice, video, or likeness in any media for the purpose of promoting, marketing, publicity, and advancing the interests of the Awards in any media worldwide, in perpetuity, without notice or without any fee being paid to the participant. 

DATA PROTECTION

All information that is provided by participant(s) when they apply for this Awards program (“personal data”), will be held, and used by Organizer and its affiliates, representatives, assigns, suppliers, and contractors to administer the Awards. 

A participant’s personal data may be turned over to any law enforcement, relevant regulatory bodies, or other authorities who during a lawful investigation of any complaints or suspected unlawful activity, or upon request by the payment processor or payment provider in connection with the billing arrangements for the Awards. 

Aggregate, non-personal data may be used for the purpose of undertaking market research or in facilitating reviews, developments, and improvements to relevant services. 

By submitting their personal details, the participant agrees and authorizes the Organizer to process those details for purposes of operating the Awards and in accordance with these Terms and Conditions, and the Privacy Policy which can be viewed at https://www.voiawards.com

Any person who is entering or has entered the Awards may opt out of receiving any marketing communications from Organizer, by making the appropriate selection in the Official Application. If a participant opts out of the Awards notifications or communications and misses a deadline to submit information, the participant will be disqualified.

The Organizer shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation, any successor legislation, or other applicable law. 

LIABILITY

Organizer will not assume or accept any responsibility and shall not be held liable for any damage, loss, injury, or disappointment suffered by any person applying or participating in the Awards, or because of any travel, or because of accepting any prize, or because of accepting any training. 

Each applicant is solely responsible for all costs, expenses, or fees incurred in connection with these Awards, and for all taxes, levies or other assessments imposed by any government organization in connection with any prizes that may be received in these Awards.

Organizer is not responsible for any problems or technical malfunction of any internet network or computer online systems, servers, or providers, computer equipment, software failure of any email or application to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in connection with the Awards. 

The organizer cannot promise that the services relating to the Awards will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance, or repair or for reasons beyond the control of the Organizer.

The organizer will not be liable if all or any part of the service relating to the Awards is discontinued, modified, or changed in any way. The Organizer is not responsible for the delivery of any gifts, prizes, or other items offered by a 3d party such as a Sponsor, Official Resource Partner, or other person or entity, and shall not be held liable for the failure of any party to deliver such gifts or prizes.  

INDEMNITY

Participant agrees to indemnify and hold harmless and defend Organizer, its Member(s), officers, agents, employees, and assigns, from and against all claims and suits by third parties for all damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from participant’s use or performance of the Content, including all such causes of action based upon common, constitutional, or statutory law.

STANDARD TERMS

Organizer retains the sole and unfettered right to add, remove, change, amend, or modify any application requirements, rules and procedures, submission criteria, judging criteria, prizes or awards criteria, event date and location, or other Awards Details, and these Terms and Conditions, at any time.

If a participant does not or is unable to comply with or meet these Terms and Conditions and or the Awards Details, Organizer is entitled at its sole discretion to disqualify such participant, without any liability and without recourse by such disqualified participant. In these circumstances, any awards prize(s) won by the participant may be forfeited and the Organizer reserves the right to reclaim any prize(s) already distributed to the participant.

All participants must comply with any directions given to him/her by the Organizer including but not limited to all relevant laws, rules, and applicable regulatory codes. 

The invalidity or unenforceability of any provision of these Terms and Conditions or Awards Details shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
